Ben ik verplicht om een advocaat in te schakelen?

U bent niet altijd verplicht om een advocaat in te schakelen, toch zijn er zeker ook gevallen waarin u wel wettelijk verplicht bent om contact op te nemen met een advocatenkantoor, bijvoorbeeld Advocatenkantoor Phea. In eenvoudige zaken met beperkt financieel belang bent u niet verplicht om een advocaat in te schakelen en kunt u zich laten bijstaan door een juridisch adviseur naar keuze. In theorie kunt u er ook voor kiezen om zelf te procederen, maar dat komt in de praktijk weinig voor vanwege de complexiteit van het procesrecht en relevante wet- en regelgeving.

Kantonrechter zonder vertegenwoordiging

Bij bestuursrechtzaken, bij conflicten tussen overheid en burger, geldt doorgaans de regel dat vertegenwoordiging van een advocaat niet verplicht is. Zelfs als u in hoger beroep zou willen gaan tegen de beslissing van de rechter, bent u niet verplicht om een advocaat in te schakelen. Het kan dan gaan om conflicten over uitkeringen, het weigeren van een vergunning of belastingtechnische problemen.

Ook bij strafzaken geldt dat u het recht heeft om uzelf te verdedigen tegen de verdenking van een strafbaar feit.

Wanneer wel verplicht?

In het familierecht bent u wel verplicht om te procederen met procesvertegenwoordiging door een advocaat. Bij het aanvragen van een echtscheiding moet u een advocaat inschakelen.

Ook bij zaken die een groot financieel belang hebben, vanaf 25.000 euro dus, bent u verplicht om een advocaat in te schakelen. Hetzelfde geldt wanneer u in hoger beroep gaat tegen de uitspraak van de kantonrechter in het arbeids- of huurrecht. Verplichte procesvertegenwoordiging geldt ook bij cassatiezaken bij de Hoge Raad.

  1. Goed om te weten in welke situaties ik een advocaat moet inschakelen. Daarnaast blijft het natuurlijk een stukje extra zekerheid wanneer je in een lastige situatie bevindt. Interessant om te lezen dat je bij strafzaken wel het recht hebt om jezelf te verdedigen.

  2. Dat het verplicht is om in het familierecht te procederen met een advocaat wist ik niet. Toch heeft dit waarschijnlijk veel voordelen en biedt het bescherming voor beide partijen. Ook is er vaak niet genoeg kennis in huis om zelf te procederen.
